論文提要
本文主要是為自願主動安樂死尋求一可行的合理說法。安樂死本身是一道德兩難，在目前愈益發達的醫療技術來看，這個問題將無法解決，會持續存在，故有必要要為安樂死提出一看法，真正的解決安樂死的問題。本文觀點設限於自願主動安樂死，其他方式及種類的在此不予討論。
本文嘗試去分析自願主動安樂死是否在道德上可以成立的說法。在整理了當前討論安樂死的爭議之後，發現諸多論點都太薄弱，能夠被取代或反駁。學界中最可能證立自願主動安樂死的是病人的死亡權的論據，本文乃進一步以權利的概念來詮釋死亡權與安樂死。首先以康德的自律來認可通過人的自由意志而做的決定即自律，是道德的，包括決定自己的死亡，因而可以支持自願安樂死；其次討論彼得辛格支持安樂死的論據，即通過批判希波克拉底宣言支持醫生可以為了解除病人的病痛而殺害病人的論述；最後回到儒家討論生命價值的看法來回應生命的確可能會處於生命價值降低的狀態，儒家肯定有條件的自殺和安樂死。由此可見，中西三主要倫理學理論都可證成人具有某種限度的死亡權。但一如所有權利都有權限所在，此死亡權的行使也在某些情況下才可實行。
在死亡權的意義底下，我們肯定人可以要求主動安樂死。但安樂死畢竟不同於醫助自殺，安樂死的實施必須是由第二人執行。從死亡權的角度來看，人具有一權利，意味著旁人也具有一義務，在安樂死的問題上來說，醫生通常是義務人，因為病人與醫生關係密切，醫生具有專業知識能夠為病人的病情做判斷與處理。換言之，當末期病人要求安樂死，醫生具有一義務來協助病人行使其權，即協助病人行使死亡權。若是醫生本身不願意替病人施行安樂死，也應將病人轉介至相關醫療機構，即，消極來說，醫生不能妨害病人行使死亡權，即不能妨礙病人要求安樂死的決定或實施。
